Terms of Use

Short version: Flaspek is provided as-is for personal use. Don't misuse it, don't reverse-engineer it, and the developer is not liable if something goes wrong. Apple's standard App Store license also applies.

1. Acceptance

By downloading, installing, or using the Flaspek mobile application ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the App.

Subject to your compliance with these Terms and Apple's Standard EULA for App Store Apps, you are granted a limited, non-exclusive, non-transferable, revocable license to download and use the App on any Apple device that you own or control, for your personal, non-commercial use.

You retain full ownership of any text, messages, or content you create using the App. The App processes your content locally on your device and does not transmit it to the developer or any third party (other than Apple's speech recognition service, as described in the Privacy Policy).

5. Intellectual Property

The App, including its source code, design, graphics, and trademarks, is the property of the developer and is protected by copyright and other intellectual property laws. These Terms do not grant you any rights to the developer's trademarks or branding.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. THE DEVELOPER DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT SPEECH RECOGNITION WILL BE ACCURATE.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY.

8. Third-Party Services

The App uses Apple's operating system frameworks, including Speech Recognition. Your use of these services is governed by Apple's terms and privacy policy. The developer is not responsible for the availability, accuracy, or behavior of Apple's services.

9. Changes to the App

The developer may release updates, modify features, or discontinue the App at any time, with or without notice. New features may be subject to additional terms communicated at the time of release.

10. Termination

These Terms remain in effect until terminated. You may terminate them at any time by deleting the App from your device. The developer may terminate or suspend your access to the App at any time if you violate these Terms.

11. Changes to These Terms

The developer may update these Terms from time to time. The "Last updated" date at the top will reflect any changes. Material changes will also be noted in the App's release notes. Continued use of the App after changes constitutes acceptance.

12. Apple-Specific Terms

You acknowledge that these Terms are between you and the developer, not Apple. Apple is not responsible for the App or its content. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the App. Apple has no other warranty obligation whatsoever with respect to the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the country of the developer's residence, without regard to its conflict of law principles. Any disputes arising out of these Terms shall be resolved in the courts of competent jurisdiction in that country, unless mandatory consumer protection laws of your country of residence provide otherwise.

14. Subscriptions and Purchases (Flaspek Pro)

The App is free to use with a daily limit on the number of new signs you can show. Flaspek Pro removes that limit and is offered in two ways:

Payment is charged to your Apple Account when you confirm the purchase. The price is shown in the App before you confirm and may vary by country and currency.

Auto-renewal. The weekly subscription renews automatically at the same price unless you cancel it at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the current period ends. You can manage or cancel the subscription at any time in your device's Settings → your name → Subscriptions, or through the App Store. Cancellation takes effect at the end of the current billing period; the unused part of a period is not refunded unless required by applicable law.

Lifetime purchase. Flaspek Pro Lifetime is a non-consumable purchase. If you also have an active weekly subscription, you should cancel it yourself; the App does not cancel subscriptions on your behalf.

Restoring purchases. Purchases are tied to your Apple Account. After reinstalling the App or switching devices, use Restore on the Pro screen to restore them.

Refunds. All purchases are processed by Apple. Refund requests are handled by Apple under its terms at reportaproblem.apple.com. Apple's Media Services Terms and Conditions also apply to every purchase.

There is currently no free trial. If a trial or promotional offer is introduced later, its length and the price charged after it will be shown in the App before you confirm.
